These Terms of Service (“Terms”) govern your access to and use of https://www.zoofyla.com (the “Site”), and any purchase of products from Zoofyla (“Zoofyla,” “we,” “us,” or “our”). By accessing the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

These Terms should be read together with our Privacy Policy, Shipping Policy, and Return & Refund Policy. If there is a conflict about shipping or returns, those policies control for those topics.

1. Eligibility

You must be at least 18 years old (or the age of majority in your state) to use the Site and place an order. By using the Site, you represent that you meet this requirement and that the information you provide is accurate and complete.

2. Our products

Zoofyla sells pet toys and related pet products intended for use with pets under adult supervision. Product descriptions, images, colors, sizes, and packaging on the Site are for reference. Actual products may vary slightly due to manufacturing, lighting, display settings, or packaging updates.

We reserve the right to correct errors, update product information, limit quantities, discontinue products, and refuse or cancel any order at our discretion, including orders that appear fraudulent or that we cannot fulfill.

3. Pet product disclaimer

Our products are not medical devices, veterinary treatments, or substitutes for professional veterinary care. Nothing on the Site constitutes veterinary, medical, or professional advice.

You are responsible for:

Choosing products appropriate for your pet’s size, breed, age, chewing strength, and temperament
Supervising your pet during use
Inspecting toys regularly and discarding damaged toys
Preventing choking, ingestion of parts, or other misuse

Pets may chew, destroy, or ingest toys. Use of our products is at your own risk. To the fullest extent permitted by law, we are not liable for injury to pets or people, property damage, or other losses arising from product use, misuse, or failure to supervise.

4. Accounts

You may browse and purchase as a guest or create an account. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at [email protected] if you suspect unauthorized use.

5. Orders and pricing

Placing an order is an offer to buy. We may accept or reject your order. An order is accepted when we send an order confirmation and/or when we process payment and prepare shipment. We may cancel an order before shipment if a product is unavailable, pricing is incorrect, payment cannot be verified, or we suspect fraud. If we cancel after charging you, we will refund the amount charged.

Prices are shown in U.S. dollars unless otherwise stated. Prices, promotions, and discounts may change at any time. Applicable sales tax and shipping charges are calculated at checkout where required. We strive for accuracy, but errors may occur. If we discover a pricing error on an order we have not yet shipped, we may cancel the order and notify you.

6. Payment

We accept the payment methods displayed at checkout. Payment is processed by third-party payment providers. By submitting payment information, you represent that you are authorized to use the payment method. We do not store full payment card numbers on our servers.

7. Shipping

Orders are shipped from China via YunExpress to addresses in the United States, as described in our Shipping Policy. Delivery times are estimates only and are not guaranteed. Risk of loss passes to you when the carrier delivers the package to the address you provided, except where applicable law requires otherwise or where we expressly agree to assist with a lost/damaged shipment under our policies.

8. Returns and refunds

Returns, exchanges, cancellations, and refunds are governed by our Return & Refund Policy. Used, chewed, or soiled pet toys are generally not eligible for return, except for defective, damaged, or incorrect items as stated in that policy.

9. Acceptable use

You agree not to:

Use the Site for any unlawful purpose
Attempt to interfere with the Site’s security, integrity, or operation
Scrape, harvest, or collect data from the Site without our permission
Submit false, misleading, or fraudulent information
Post abusive, defamatory, infringing, or illegal content in reviews or other submissions
Impersonate any person or entity

We may suspend or terminate access, cancel orders, or remove content if we believe you violated these Terms.

10. User content and reviews

If you submit reviews, comments, photos, or other content (“User Content”), you grant Zoofyla a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and display that User Content in connection with operating and marketing the Site and our products. You represent that you own or have rights to the User Content and that it does not violate any law or third-party rights.

11. Intellectual property

The Site and its content—including text, images, logos, graphics, product descriptions, and design—are owned by Zoofyla or our licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written permission, except for personal, non-commercial use as needed to browse and place orders.

12. Third-party services and links

The Site may use or link to third-party services (for example, payment processors, shipping carriers, analytics, or embedded content). We are not responsible for third-party websites, services, or their terms and privacy practices.

13. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT PRODUCTS WILL MEET YOUR SPECIFIC EXPECTATIONS.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, some of the above may not apply to you, and you may have additional rights.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ZOOFYLA AND ITS OWNERS, OPERATORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SITE OR PRODUCTS.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR A PRODUCT PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain liability limitations. In those jurisdictions, some of the above may not apply to you.

15. Indemnification

You agree to defend, indemnify, and hold harmless Zoofyla and its owners, operators, and service providers from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, your User Content, or your use of our products (including failure to supervise pets or misuse of products).

16. Governing law and disputes

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles, except that consumer protection laws of your state of residence may also apply.

If a dispute arises, please contact us first at [email protected] so we can try to resolve it informally. If we cannot resolve it, courts located in the United States will have exclusive jurisdiction, except where applicable law gives you the right to bring claims in your local courts.

17. Changes to the Site or Terms

We may update the Site and these Terms from time to time. The “Last updated” date at the top will reflect changes. Continued use of the Site after an update means you accept the revised Terms. The version in effect when you place an order applies to that order.

18. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, form the entire agreement between you and Zoofyla regarding the Site and purchases, and supersede prior agreements on those subjects.
